These Terms and Conditions regulate access to and use of the Garrafeira Tesouros de Baco website (hereinafter referred to as the Website), owned by Isabela Rodrigues Cupello Gomes Ferreria. (hereinafter referred to as “Garrafeira Tesouros de Baco”), with NIF: 295022680, as well as the conditions of sale of services and products offered by Garrafeira Tesouros de Baco on its website.

As a user of Garrafeira Tesouros de Baco, you must fully accept these conditions of use, as well as the different modifications and/or additional legal texts that Garrafeira Tesouros de Baco may include in the future.

2. User Data and Conduct on the Website

To be able to purchase the products offered through the Website, users may choose between:

  • Register in advance: the user can register by filling out the registration form at the top of this website or during checkout, indicating the option to create an account. 3. Orders and Sales Conditions

Garrafeira Tesouros de Baco accepts orders for Portugal (including the islands) and Spain (excluding islands and regions of Ceuta, Melilla, and Gibraltar) and the rest of the European Union (sales locations). Different destinations are subject to the shipping conditions established on the website (see section 7.2).

Under no circumstances will Garrafeira Tesouros de Baco intentionally offer for sale more units than it has available. In the event that the product is not available after the order has been placed, the user will be informed by email or phone, offering the option to postpone delivery, exchange the product for a similar one, or receive a refund of the amount paid.

4. Prices

All prices of products indicated through the website are expressed in euros and include VAT and other taxes that may apply.

5. Payment Methods

Payments are always made in euros, even when prices are shown in other currencies. Some banks may charge exchange rates. Garrafeira Tesouros de Baco is totally unaware of this fact and does not assume any responsibility for it.

Once the order has been placed, i.e., after acceptance of these Terms and Conditions and after payment of the order, Garrafeira Tesouros de Baco will always send an email to the user confirming the details of the purchase made and the corresponding order form. The order will only be shipped after Garrafeira Tesouro de Baco receives confirmation that the payment has been finalized.

To pay for your order, in the payments area of the Checkout page, you can select the payment method that is most convenient for you:

5.1 MB WAY

When you select this payment method, during checkout you will be asked for your phone number so that, after finalizing, you can confirm the payment in the following minutes.

You have 5 minutes to make the payment. We will be automatically notified after your payment.

5.2 ATM Reference (MB)

In the ordering process you can select payment via ATM, which will generate a payment reference. We will be automatically notified after your payment.

Payments by ATM Reference can be made through the ATM Network or through your Homebanking. At the end of your order, an ATM reference will be automatically generated. You will receive this reference in the order confirmation email, and it will also be available in your customer account if you have an account registered on the Garrafeira Tesouros de Baco website.

To make the payment at an ATM, you must select the option “Payment for Services/Purchases” and enter the corresponding entity, reference and amount.

The products in your order are reserved for 5 days. If Garrafeira Tesouros de Baco does not receive payment for the order during this period, the order will be canceled.

5.3 Bank Transfer

You can choose to pay by bank transfer. The elements required to make the transfer are:

We suggest that, if possible, put the order number in the description of the movement. The costs of the transfer order will be the responsibility of the customer.

Before Garrafeira Tesouros de Baco processes your order, you will need to receive the payment and confirm it with the bank. To ensure that your order is not delayed, please provide your name, Order Number along with payment information. Your Order Number can be found in the Order Confirmation email.

The products in your order are reserved for 5 days. If Garrafeira Tesouros de Baco does not receive payment for the order during this period, the order will be canceled.

5.4 Credit Card

The user must pay the amount corresponding to their order by credit or debit card (Visa, Mastercard). We will be automatically notified after your payment.

Payment by credit card is processed by the Stripe payment gateway, which guarantees the total security of the transaction, and the respective transaction takes place over an encrypted connection by an SSL security certificate installed on our server.

5.5 Paypal

In the order process, when selecting this method, you must indicate the data (email and password) when requested and the order will be immediately considered “In Process”. You don’t need to send proof of payment.

The amount will be authorized (reserved), and will be manually captured by us when we guarantee the stock of the products in your order and the possibility of shipping to the indicated address. (confirm authorized vs captured).

Payment by Paypal is a secure method used all over the world. For more information about this payment method, please visit www.paypal.com.

The transaction is made on the PayPal’s servers, so Garrafeira Tesouro de Baco does not store the transaction data.

5.6 Payshop

We have Payshop payment available, where you can make the payment in one of the participating establishments of the Payshop network.

5.7 Payment at the Torres Vedras Store

You can make your purchases in the online store and when you select the shipping you will pick up your order at our physical store in Torres Vedras, then you can choose to make the payment at the time of pickup.

We will keep your purchase for 5 days.

How long do I have to make the payment?
The products in your order are reserved for 5 days. If Garrafeira Tesouros de Baco does not receive payment for the order during this period, the order will be canceled.

What can I do to make sure there are no delays in processing my payment?
For all payment methods with the exception of bank transfer, we will be automatically notified after making the payment. In the case of payment by bank transfer, please make sure that you provide the payment reference number at the time of payment and that you carefully follow the instructions in the email accepting your order. 6. Information about the products and services of Garrafeira Tesouro de Baco

For this reason, Garrafeira Tesouros de Baco declines any responsibility for the appearance of errors in this information, although it undertakes to take all measures within its reach to correct such errors or omissions as soon as possible after being informed of them.

7. Deadlines, delivery locations and losses

7.1. Product delivery

Garrafeira Tesouro de Baco undertakes to deliver the product in perfect condition to the address indicated by the user. In order to optimize delivery, we would like to thank you for providing an address to which the order can be delivered within normal working hours.

To avoid incidents in the delivery (wrong addresses, inability to contact someone at the address, etc.), it is essential to fill in the respective form correctly, and it is mandatory to fill in the field corresponding to the contact telephone number (it is recommended that it is a mobile phone).

Garrafeira Tesouros de Baco will not be responsible for delivery errors when these are due to the fact that the address entered in the form by the user does not fit reality, is false or has been omitted.

Without prejudice to the above, Garrafeira Tesouros de Baco undertakes to adopt the measures within its reach so that the delivery of orders can be carried out within the agreed time or, if this is not possible, so that it is carried out as soon as possible.

7.2 Shipping Costs, Delivery Time and Notification

Garrafeira Tesouros de Baco ships its orders to mainland Portugal and the islands, Spain (excluding the islands and regions of Ceuta, Melilla and Gibraltar) and other countries of the European Union (marca_confirmar_entregas), providing different delivery services for each area.

Delivery times vary, from 5 to 45 days, depending on the type of item and/or shipping address.

After order confirmation, you will be contacted via email or phone to be informed about the delivery time of the items you have ordered.

In the event of a stock-out, impossibility of meeting the characteristics of the product chosen by the customer, Garrafeira Tesouros de Baco undertakes to refund the entire amount of the order if it does not wish to wait for the product to be replenished or to change the order.

All orders placed on our website will have a maximum delivery time of 60 days. If at the end of this period it is not possible for us to deliver the order, if the customer wishes, the amount paid by the customer will be refunded to the NIB that he indicates.

By accepting these terms and conditions, the customer waives the right to receive the corresponding deposit in double.

Except for these conditions, all Promotion products, which are limited to existing stock, and their characteristics are unique.

Delivery times are estimated and count after the payment is made, where you receive the email informing you that your order is being processed. For example, if the user made their purchase by bank transfer or ATM, the delivery time of the product will start counting from the business day following the confirmation of the receipt of the order amount in the account of Garrafeira Tesouro de Baco.

Notwithstanding the above, customers are informed that the stipulated delivery dates will be estimated.

Garrafeira Tesouros de Baco informs that it will not be possible to send orders to PO boxes.

Garrafeira Tesouros de Baco will not make deliveries or shipments on Saturdays and Sundays, nor on national or municipal holidays.

7.3 Shipping Costs

To know for sure the shipping cost for the products you want to buy and delivery location, add the respective products you want to the cart. On the Cart page or on the Checkout page, you will be shown the shipping cost after filling in your address.

7.4 Ways of Delivery

Garrafeira Tesouros de Baco chooses the most appropriate logistics partner for the user’s delivery address.

Garrafeira Tesouro de Baco is not responsible for any delays that are the responsibility of the carrier.

7.5 Due diligence in delivery

The user must prove that the order is in good condition. In case it is not in good condition, it is important to have photos for its evaluation and subsequent complaint.

If the customer detects any anomaly in the product, they must indicate it on the delivery receipt and report it to Garrafeira Tesouros de Baco through the email: [email protected].

8. Returns and Right of Withdrawal

8.1. Returns due to manufacturing defects

All products offered through the Website will be completely original, unless otherwise stated in the description. All of them have a warranty period of 3 years from the receipt of the product. This warranty shall be provided by the Supplier.

Bearing in mind that the Website sells products that have a life/use period typically of less than 2 years, it will be understood, unless proven otherwise, that the products are in accordance with the contract as long as they meet all the requirements that are mentioned below: (a) conform to the description given by the seller and have the product characteristics presented by the seller to the user in the form of a sample model; (b) are fit for use for which products of the same type are intended; (c) have the usual quality and characteristics of a product of the same type as the consumer and user may reasonably expect, in accordance with the nature of the product.

During the warranty period, the user may return to Garrafeira Tesouro de Baco, at no cost except the possible cost of sending us the item, any product that has a manufacturing defect. To formalize the return, the user must contact Garrafeira Tesouro de Baco, through email [email protected], indicating the product or products object of the return, the detailed information of the defects found in them and attaching the photograph. After receiving this communication, the customer service team of Garrafeira Tesouros de Baco will manage the collection of the defective product for shipment to our facilities, at no cost to the user.

In the event of a defective product, Garrafeira Tesouros de Baco will proceed, according to what is necessary, to repair, replace, reduce the price or terminate the contract, actions that will be free of charge for the customer. The customer must inform the seller of the lack of conformity within two months of becoming aware of it.

Each product to be returned must be unused and with all the original labels, packaging and, if applicable, documentation and accessories that came with it. If the user does not do so, Garrafeira Tesouro de Baco reserves the right to refuse the return.

Once the product has been received, Tesouros de Baco Wine Cellar will refund the corresponding amounts paid, as soon as possible and, in any case, within fourteen (14) days following the receipt of the product at the premises of Garrafeira Tesouros de Baco.

8.2. Right of Free Termination of Contract

The customer has a period of 30 consecutive days, from the date of delivery of the goods, to return their order, and without the need to indicate the reason, in accordance with the provisions of Decree-Law No. 109-G/2021 and Decree-Law No. 84/2021, of December 10, 2021, and the Customer is responsible for the direct cost of the exchange or return requested.

Products that are produced according to the Customer’s specifications or manifestly customized are excluded from the Right of Free Resolution. Please contact us if you have any questions and want to be sure before making the purchase.

To exercise your right, you must communicate by e-mail [email protected], informing you of your decision to terminate this contract by means of an unequivocal statement. We will not accept any items addressed to us without prior contact.

8.3. Withdrawals, Exchanges and Returns

For exchanges or returns, the customer is requested to contact Garrafeira Tesouros de Baco through the e-mail [email protected] indicating the order number or the document that accompanied it, taking into account the conditions detailed below in the following topics:

a) To return the order, the product must be in perfect condition, and if applicable with its original packaging, accessories or promotional offers included, and accompanied by proof of purchase or invoice.

b) The return of defective products and erroneous shipments will be admitted, and Garrafeira Tesouros de Baco will be responsible for the shipping and collection costs whenever the customer communicates this circumstance within 30 (thirty) days from the date of receipt of the product.

c) Once the goods have been received at our facilities and after validating the condition of the goods accordingly, their value will be refunded according to the payment method made by the customer, or another solution previously agreed with the customer.

9. Intellectual and Industrial Property

All rights to the content, design and source code of this Website and, in particular, but not limited to, to the photographs, images, texts, logos, designs, trademarks, trade names, data included in the Website and any other intellectual and industrial property rights, are the property of Garrafeira Tesouros de Baco. to whom the exclusive exercise of the rights of exploitation of the same corresponds, or, if applicable, Garrafeira Tesouro de Baco has a license or authorization from the authors, and are protected by Portuguese law, under the Code of Copyright and Related Rights, the Industrial Property Code and other applicable legislation, as well as by international treaties, copyrights or trademarks.

Garrafeira Tesouros de Baco does not grant any licence or authorisation for the use of any kind on its intellectual and industrial property rights or on any other property or right related to the Website, and in no case shall it be understood that the user’s access and browsing implies a waiver, transmission, licence or total or partial assignment of said rights by Garrafeira Tesouros de Baco.

Any use of these contents that has not been previously authorized by Garrafeira Tesouro de Baco will be considered a serious breach of intellectual or industrial property rights and will give rise to the legally established responsibilities.

10. Liability

Garrafeira Tesouros de Baco does not grant any guarantee nor is it responsible, under any circumstances, for damages or losses of any nature that may derive from the access or use of the products or contents of the Website. Among others, and by way of example, but not limited to, Garrafeira Tesouro de Baco is not responsible for the following consequences:

Loss, damage, withholding or delay in delivery of the order due to unforeseeable causes, force majeure or acts attributed to the user.

The lack of effective availability, maintenance and operation of the Website and/or the services or contents, excluding, to the maximum extent permitted by current legislation, any liability for damages of any nature that may be due to the lack of availability or continuity of the operation of the Website, such as, for example, errors or delays in the access to the Website by the user at the time of entering their data in the order form, the slowness or impossibility of receipt by the recipients of the order confirmation or any anomaly that may arise and that is unrelated to the good faith of Garrafeira Tesouro de Baco.

The lack of usefulness of the Website or the contents for any service.

The content of other websites to which links placed on the Website may be directed.

The existence of viruses, malicious or harmful programs on the Website.

In any case, Garrafeira Tesouros de Baco undertakes to solve any problems that may arise and to offer all the necessary support to the user to reach a quick and satisfactory solution to the incident. 14. Nullity and effectiveness of clauses

15. Governing Law

Portuguese law is applicable to the Terms and Conditions presented, governed by the District of Lisbon North, and any other jurisdiction is hereby rejected.
